Our Practice

The purpose of MOMAG's practice is to advise the State and its agencies on legislative, regulatory issues or the exercise of public powers; and, to individuals in matters related to public procurement, the exercise of sanctioning powers, authorizing activity - in different regulated sectors -, and the preventive and strategic treatment of any type of conflicts that may arise in civil judicial venues, special or arbitration, national or international. With the same vision, the practice of the study is also aimed at advising business, union or any type of organization, with the aim of establishing improvements in their respective corporate governance, including the identification and management of the administration risks that arise. detected through legal reviews or audits entrusted to them.

He legal matters that are understood to be included in this practice are, among others, the following:

Administrative acts and resources governed by Law No. 19,880 or special ones; public procurement; public function; expropriations; public enterprises; municipal law; and, responsibility of the State.

Public tenders governed by Law No. 19,886 and, in general, contracts or agreements of the State administration between the entities that comprise it or with individuals; public works construction contracts; infrastructure concessions other concession figures for public services or national goods for public use.

Building permits and preliminary projects, postponement of projects; urban planification; environmental, cultural or social protection of protected areas.


Regulatory regime for the environmental evaluation procedure, sector permits and environmental qualification resolution; compliance plans; sanctioning procedures; environmental conflicts before the Committee of Ministers and the civil and environmental courts, and environmental liability.
 

Development of defense strategies in relation to potential or pertinent contingencies to consumer law, mediations in administrative headquarters and defense of interests before courts of civil jurisdiction.

Investigations, compliance, audits and risk prevention analysis in the administration of corporate governance of companies or corporations.

Telecommunications law; health law (DFL 382); Health Code; electrical law; and customs law.
